Terms and conditions

Welcome to our apartment booking platform! Please read these terms and conditions carefully before using our services.

The Open House apartments reservation platform is part of the Open House Imobiliare Group, which is owned by DMO INVEST Group SRL, with its registered office in Timișoara, str. Invățatorului, 4, et. 2, ap. 10, Timiș county, registered at the Trade Registry Office next to the Timiș Court under no. J35/36/2014, having CUI 32630311, email [email protected]. To facilitate the transmission of information, we will consider using the term "Check-in online" to refer to Online Registration, respectively the terms "Check-in online form" to fill in the accommodation form or "Open House apartments" to refer to to the Booking Platform and the purchase of accommodation services.

By making a reservation or by completing the online Check-in at any of the accommodation units belonging to the Open House apartments service provider, the client/guest expressly agrees to the Terms and Conditions.

Reservations and confirmations:
- By using our platform, you undertake to provide accurate and complete information for the booking process.
- The booking confirmation is issued after the payment is completed and is sent to the e-mail address provided by you.
- In the case of reservations made by phone or e-mail, the reservation is guaranteed by the client/guest by paying an advance established in the reservation pre-approval e-mail, they will be registered with the status "pending". In this case:
- In no more than 24 hours, the client/guest will have to provide proof of payment of the minimum advance payment, after the expiration of the 24-hour period, the reservation status will become "cancelled" and the dates in the calendar will be available again.
- In the case of reservations made through specialized platforms such as Airbnb or Booking.com, they will automatically come with the status "confirmed"
- Clients/guests will receive a confirmation e-mail regarding their reservation as well as steps to complete "Check-in online"
Payments and Cancellation Policy:
- Payment for reservations is made only by bank transfer or via the payment link provided in the confirmation email
- Bank transfer or card. Cash payments are not accepted.
- Payments are processed in advance to confirm the Reservation by paying an advance of at least 30% of the total value of the reservation in the first 24 hours and the difference until the check-in date at the latest.
- Our cancellation policy varies by property and is specified in detail on the reservation page of each accommodation unit as well as on the check-out page of the specialized platforms.
- If the guest wants to cancel the reservation, the guarantee will be returned as follows:
0% if canceling 2 days before the arrival date
70% if canceling 5 days before the arrival date
100% if canceling up to 5 days before the arrival date

The owner may also have the right to cancel the guests' stay if the house rules are violated during the rental period.

Damage deposit:
- A damage deposit must be given to the owner as soon as this contract is accepted by both parties and before the guest arrives at the property. The damage deposit will be returned to the guest in full after an inspection of the property on the day of departure. If there is damage to the property or the house rules or restrictions were not respected, the owner has the right to keep the damage deposit.

Maximum occupancy:
- The maximum number of guests who are allowed to stay in the property during the rental period is the maximum capacity accepted for each unit and specified in its description, only if the owner gives his consent in writing. An amount at the price norm #name_rates will be charged/person for each extra person over the maximum number of persons admitted. Guests will be charged without any notification by the owner for each guest.

Cleaning fee:
- The guest will pay a cleaning/stay fee that will be displayed on the booking page and will be calculated for the entire stay. Daily cleaning is not included in the cleaning fee or in the nightly price.
During the stay, the guest is obliged to maintain cleanliness in good condition. Any defect or damage must be immediately reported to the owner. The guest acknowledges that on the date of arrival, the property is in good condition, with the exception of any defect that the guest can report to the owner until the end of the first day of occupancy.
The property must be left in the same condition in which it was found by the guest on the date of arrival. The guest promises to leave the property in good condition.

Furniture and equipment:
- Furniture, bed linen, towels, kitchen equipment, utensils, decorations or any other personal property provided with the property must not be removed from the property.
- The guest will be charged for the loss or destruction of any object in the property or the wear and tear of the furniture beyond the normal limit.
- The guest must notify the owner immediately if he breaks or damages any object in the property.
- The owner will inspect the property upon the guest's departure and will notify him if he finds any damage to the property or to an object in the property.

House Rules:
- The guest agrees to respect the following rules of the house at all times and will ensure that all rented guests and anyone else who has permission to enter the property respects them:
- The main guest must be at least 18 years old
- Smoking in the property is prohibited, except where a special smoking area is indicated.
- Pets are prohibited from entering the property unless the owner gives written consent to this effect.
- To respect the indicated check-in and check-out times
- Parties or group gatherings are prohibited
- To respect the quiet hours of the condominium where the property is a part.
- To respect the other internal rules of the condominium where the property is a part, including picking up and selecting household garbage in the indicated place.
- Do not enter the property with shoes on.

Parking:
- The guest will be informed in advance about the parking place, how to get there and how to use the parking place during the entire stay.
The owner will not be responsible for any damage to the vehicle parked in the place indicated by the owner. The guest is responsible for his vehicle even if the owner provides a private parking space.

Mechanical faults:
- The owner tries to properly maintain the property. While all electric and
the mechanical equipment within the Property is in good working condition, the Owner cannot guarantee
mechanical failure of the electrical service, sanitary installations stopped, water supply, heating, air conditioning, audio
visual equipment, internet access, cable services or household appliances. The guest agrees to report any malfunction of the equipment or other maintenance problem to the owner immediately. The owner will use all reasonable efforts
to make repairs quickly and efficiently.
- The guest will allow the Owner or a person allowed by the Owner
access to the Property for the purpose of repairs and inspection. The owner is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to the failure of these items.

Fortuitous case:
- If there is a storm or severe weather and a mandatory evacuation order is issued by local or state authorities, Guests will be entitled to a proportional refund for each night that the Guest cannot occupy the Property. The Owner shall not be liable or held liable under this Agreement for any failure to perform or delay in the performance of any of its obligations due to or arising from any act beyond its control or, including, without limitation, its control. The cases of force majeure are those from the practice of the International Court of Arbitration in Paris and included in the Uniform Rules and Usages (RUU) of this court.

Privacy policy:

We use security measures to protect your information, but cannot accept responsibility for losses caused by events beyond our control.
The data requested from you may be, for example, those related to name and surname, CNP, address, telephone, e-mail, etc.

Updates to the Terms and Conditions:
- We reserve the right to update and modify these terms and conditions without prior notice.
- Any changes will be displayed on our platform. By using our platform, you agree to these terms and conditions.
